The Application (“the App”) facilitates your virtual exploration and communication with wedding venues, photo locations and wedding suppliers, enabling you to locate spaces, products and services, in an efficient and secure manner.
The App operates as WeddingExpo3D®, which is a brand owned by EventSpace3D Pty Ltd ACN 632 604 141.
Your right to use the App and any associated products or services is governed by these Terms and Conditions (“the Terms”).
Installation and/or usage of the App or any associated products or services is your agreement that you have read, understood and agreed to be bound by these Terms. Please read the Terms carefully. If you do not agree with the Terms you must stop usage of the App immediately.
WeddingExpo3D may change any of the Terms at any time by updating this page. Changes to the Terms shall take immediate effect.
2) Your Acceptance
You accept the Terms by installing the App or by acceptance in any other way.
3) Access To Features
All relevant browsing features in the app can be used by “Guest Users” with no registration or signup being required.
Some additional features, including, but not limited to the saving (bookmarking) of favourites, requires you to complete a simple registration as a user so that you can return to your saves.
Signing up for the App requires your:
First Name
Last Name
Email address
Password (will be encrypted for your security)
You must not sign up if:
you are under 18 years of age; or
it would be unlawful for you to use the app
4) Your Agreement
You shall:
only use the App in line with the Terms and in accordance with the laws of Australia;
not permit any person to use the App in your name and protect your Personal Information at all times and be solely responsible for the protection of confidentiality of your Personal Information;
immediately notify WeddingExpo3D of any unauthorised use of your Personal Information or any breach of security in respect of the App of which you become aware;
You shall not:-
use the App in any way other than in accordance with the Terms and for the purpose in clause 1;
share your Personal Information with any other persons;
use the App or the Services for any commercial purpose;
use the App or the Services for any illegal and/or unauthorised purpose
5) Copyright and Intellectual Property
The App, and all related tools of WeddingExpo3D are protected by and subject to copyright under the laws of Australia and internationally. This includes, but is not limited to all software, text, graphics, images, audio clips, logos, codes, scripts, button icons and other elements or features.
Subject to your strict compliance with these Terms and Conditions, WeddingExpo3D grants to you a non-exclusive, royalty free, revocable user license to use the App pursuant to the Terms for your own personal and non-commercial use.
WeddingExpo3D remains the owner of all information residing on the App at any time together with all rights, title and interest in and to the App.
Under no circumstances do you acquire any ownership rights in any assets of WeddingExpo3D, including but not limited to trading name, domain name, trademark, business name, registered copyright; or any know-how, system or process of WeddingExpo3D.
You must not at any time or in any way copy, modify, translate or create any derivative system or operation based on the App; republish, transmit, post, distribute, broadcast, upload to another party or change the Services for any purpose otherwise than in accordance with the Terms.
6) Photography and other 3rd party content
The vast majority of photos used in venue listings were produced by WeddingExpo3D.
In addition, WeddingExpo3D have in good faith at times used photos from venue websites as part of creating a free venue listing on the app.
Where possible to be identified on the venue website, WeddingExpo3D have diligently published the necessary Photo Credits and links to the originating photographer in each listing.
In the event that you discover any photography works that you are the author of, it is very likely that we were unable to identify your details on the venue website at the time of creating the venue listing, or that we were unable to link particular images to the exact author without making errors.
This was done with the best of intentions and to give you more exposure, rather than accidentally credit the wrong photographer with somebody else’s work.
We respectfully request for you to immediately get in touch and advise us of your details, so that we can assign the necessary branding/references to the photo/s for your benefit.
In the event that you like us to remove any content, please contact us via the Contact Page in the app itself and point us in the right direction, we will immediately remove your content if so desired.
7) 3D content
All 3D content on the app is the property of WeddingExpo3D and exclusively produced for WeddingExpo3D.
None of the 3D tours are to be used for any other purpose than the virtual experience within the app or without the written approval of WeddingExpo3D or EventSpace3D Australia Pty Ltd.
8) Privacy
WeddingExpo3D operates in accordance with Australian Privacy Principles and complies with the Privacy Act 1988 (Cwth). A copy of our Privacy Policy is available on the EventSpace3D website at www.eventspace3d.com
9) Limitation of Liability
WeddingExpo3D, its employees, agents, contractors and licensees shall not be liable to you for any incidental, consequential or exemplary damages or loss of profits whether incurred directly or indirectly and in any manner or circumstance whatsoever.
10) Termination
You may terminate your user license at any time without notice to WeddingExpo3D.
WeddingExpo3D may terminate your user license and prohibit you from use of the App or the Services if you have breached any of the Terms; or if WeddingExpo3D no longer maintains the app.
11) Indemnity
You agree to indemnify WeddingExpo3D from any and all liability arising out of your use of the App, and hold harmless WeddingExpo3D in case that any technical or other issues result in a loss of saved history or other information you have accumulated in the app.
You agree to indemnify WeddingExpo3D, its employees, agents, contractors and other licensees from and against any liability arising out of or in connection with the information which you provide to WeddingExpo3D or resulting from any breach by you of the Terms.
12) Governing Law
The Terms are governed by the laws of Western Australia. You agree to submit to the laws of Western Australia in the event of any dispute or claim arising out of or in any way related to your use of the App, or the Terms.
13) General
You use the App at your own risk. The App is being provided to you without warranty and in an “as is” condition.
You acknowledge and agree that you have received no representation from WeddingExpo3D regarding the continued availability of the App and that WeddingExpo3D shall have no liability to you in respect of any of the following:
error (including any incorrect information displayed on the App), omission, interruption, deletion, defect, failure of performance, delay of operation, loss of data, unlawful third party conduct, device or computer virus;
3rd party links;
costs or losses incurred as a result of using the App;
lack of updates
To the maximum extent permitted by law all terms, guarantees, representations, warranties or conditions that are not expressly stated in the Terms are excluded.
If any of the Terms are found to be unenforceable by a Court they shall be severed and the rest of the Terms shall remain in force and effect.
